Road Accident & Personal Injury Claim

FAAIZ Law acts for victims of road accidents and other accidents in claiming compensation for injury, death and loss caused by the negligence of others. We handle claims across Malaysia from our offices in Puchong, Durian Tunggal and Sungai Petani, serving clients in Selangor, Kuala Lumpur, Negeri Sembilan, Melaka, Perak and Kedah.

Most road accident claims are paid by the insurer of the vehicle at fault. We help clients recover damages for medical expenses, loss of income, pain and suffering, and the cost of ongoing care. We deal with insurers and opposing parties on our clients' behalf so they can focus on recovery, and we are prepared to take matters to court where a fair settlement cannot be reached. Claims arising from motor vehicle accidents are usually filed in the Sessions Court, which has unlimited jurisdiction over such claims.

Frequently Asked Questions

What should I do after a road accident?
Lodge a police report within 24 hours as required by section 52(2) of the Road Transport Act 1987, get medical treatment, and keep your medical records, receipts, photographs and the other party's details.

How long do I have to make a claim?
Generally six years from the date of the accident. A dependency claim arising from a death must be brought within three years of the death, and a shorter period of 36 months applies to claims against public authorities, so you should seek advice early.

Can I claim if I was partly at fault?
Yes. The court apportions liability between the parties and reduces the compensation according to your share of fault.

Can I claim if a family member has died?
Yes. Dependants may claim for loss of support, funeral expenses and, for the spouse, children or parents, damages for bereavement.
